This paper examines the process of negotiation of the Joint Comprehensive Plan of Action, which is an agreement on the Iranian nuclear program that was reached by Iran and P5+1 members in Vienna on July 14, 2015, by analyzing the key factors that lead to the consensus. Recent studies of the Iranian nuclear crisis suggest that the main factor that lead to the agreement of the JCPOA could be explained by the US’s tough sanctions on Iran. However, this does not explain fully the reasons why the JCPOA was agreed upon despite it tolerates Iran’s nuclear program including uranium enrichment to the certain level. This paper explains how the unstated right under the Non-Proliferation regime has affected Iran and P5+1 to reach an agreement in the Iranian nuclear negotiations that was held from 2003 to 2015, by using Risse’s “logic of arguing”. “Logic of arguing” is a communicative action that aims to achieve consensus through persuading each other by challenging validity claims of the truth, moral rightness and the truthfulness of the speaker. P5+1 succeeded in claiming the truth of Iran’s nuclear development, so Iran has accepted more robust IAEA verification system. Also, Iran succeeded in claiming the rightness of Iran’s peaceful nuclear activities by citing the right to peaceful nuclear use in the Non-Proliferation Treaty.
