内戦状況や抑圧的政治体制の下における虐殺といった重大な人権侵害に対して如何なる対応を行うかといったことが,紛争後の社会をどう再建するか,平和構築を如何にして進めていくかといった課題もと絡みつつ,重要な現代的課題の一つとなっている.紛争の発生原因に遡って根本的に解決するためには,構造的な問題を一つ一つ解決していかなければならないのは言うまでもないが,そうした構造的な制約の中,過度期の正義についての的確な対応をとり続けていくことで,状況を改善していくことも可能なはずである.本稿では,赦しやアーカイブに関するジャック・デリダの議論などを補助線として使いながら,「移行期における正義(transitional justice)」の望ましい方向性について検討していった.そして,復讐へと傾斜したものについては赦しの方向へ,忘却へと傾斜したものについては記憶の方向へといったようにそれぞれ,いずれも何らかの形で不十分な対応を改めていく必要性があることを確認した上で,語りによる歴史物語の書き換えの動きの活性化,記憶再編の可動幅や共有化される記憶の地平の拡大が,沈黙を強いる抑圧的な構造的権力の解体と同時に重要であることを指摘した. How to respond to serious human rights abuses during civil wars or under repressive authoritarian regimes? This kind of ""transitional justice"" problem becomes one of very important issues for a contemporary world society. What kind of response is the best such as transitional justice? The aim of this article is to try to answer that question by consulting Jacques Derrida's deconstructive arguments on forgiveness and archive. According to the tentative conclusion, it is necessary to amend too much retribution by aiming for the impossibility such as unconditional forgiveness or to correct a tendency to t forget the loathsome past by keeping open archives with poly-phonic narratives. It is very important for reconstructing the post-conflict society to rewrite the historical narrative and to enlarge the common terrain of memory with some degree of retributive justice.
